I, Kim Atwell, am the data controller and processor of Kim Atwell Therapy. The basis for maintaining any data pertaining to clients is that of ‘Legitimate Interests’, that the data is necessary to fulfil the contract of providing counselling and psychotherapy (therapy) and that is data that you would reasonably expect me to maintain and make use of.

I am a full, registered member of the UK Council for Psychotherapy (UKCP) and adhere to their professional guidelines and codes of ethical practice.
What Type of Personal Information I Collect
I currently collect and process the following information:

Client name and email address, mobile or landline number, home address.

Medical surgery and Doctor’s contact details + medication information.

Name and contact number of a nominated person in the event of an emergency.

Clinical notes
Some of the information you give me may fall within the special category of data as defined by the General Protection Regulation. The condition for processing this special data “is processing necessary for medical diagnosis, provision of healthcare or treatment pursuant to contract with a heal professional.”
How I Get Personal Information & Why We Have It
Most of the personal information I process is provided to me directly by you for one of the following reasons:

To enable me to discuss and arrange clinical appointments for the provision of therapy.

Any records I make are kept securely and separately from your contact details by a unique unidentifiable code (not name).
I do not share information of your personal details with any third parties, except possibly with other medical professionals, with you full consent.
Under the UK General Data Protection Regulation (UK GDPR), the lawful bases I rely on for processing this information are:
(a) Your consent. You are able to remove your consent at any time. You can do this by contacting me on the email above.
(b) I have a contractual obligation. The data I gather is necessary to fulfil the contract of providing therapy and that it is data that you would reasonably expect me to maintain, and additionally to make use of.
How I Store Your Personal Information
Your information is securely stored. I keep your contact email and mobile number securely on my computer and mobile, both are password protected for the duration of your therapy. When your therapy finishes, I will then delete these details.
Any records I make are handwritten and not stored digitally, but kept securely in a locked cabinet and stored separately from your contact details so they remain confidential and cannot be linked. Notes are held for 7 years in line with industry guidelines. After this time this information is shredded.

Under data protection law, you have rights including:
Your right of access - You have the right to ask us for copies of your personal information.
Your right to rectification - You have the right to ask me to rectify personal information you think is inaccurate. You also have the right to ask me to complete information you think is incomplete.
Your right to erasure - You have the right to ask me to erase your personal information in certain circumstances.
Your right to restriction of processing - You have the right to ask me to restrict the processing of your personal information in certain circumstances.
Your right to object to processing - You have the the right to object to the processing of your personal information in certain circumstances.
Your right to data portability - You have the right to ask that I transfer the personal information you gave us to another organisation, or to you, in certain circumstances.
You are not required to pay any charge for exercising your rights. If you make a request, I have one month to respond to you.
